Galloway Getaways Ltd (company number SC899385), registered office 17b King Street, Castle Douglas, DG7 1AA ("we", "us", "Galloway Getaways") and you, the business listing an experience ("you", "the Provider").
Version: v1-2026-10-03
You offer experiences, activities, food or other services to guests staying in accommodation booked through our platform. We advertise what you offer, collect payment from the guest as your agent, and pass the money to you less our commission.
We do not organise, run, supervise or control anything you provide. You do.
2.1 When a guest books your experience, the contract for that experience is between you and the guest. We are not a party to it.
2.2 You appoint us as your agent to advertise your experiences, to collect payment from guests on your behalf, to deduct our commission, and to remit the balance to you. Payment by a guest to us discharges their obligation to pay you.
2.3 You authorise us to issue booking confirmations and receipts to guests on your behalf.
3.1 Providing the experience as described, safely, and to the standard a guest would reasonably expect.
3.2 Holding every licence, permission, registration, qualification and certification the law requires for what you do, and keeping them current.
3.3 Holding public liability insurance appropriate to your activity, for at least the amount we specify, and providing evidence on request. You must tell us without delay if it lapses or is cancelled.
3.4 Complying with all applicable law, including health and safety, food hygiene and allergen law, licensing, and consumer law.
3.5 Keeping your listing accurate: what is included, what is not, duration, location, group size, age limits, physical requirements, allergens and dietary provision.
3.6 Responding to booking requests and guest messages promptly, and honouring every booking you accept.
We may review your listing before it appears. That review is not an endorsement, and is not a warranty as to your skills, quality, suitability, qualifications, credentials, insurance or compliance with the law. We do not verify what you tell us. You are solely responsible for being what you say you are.
5.1 You set your prices. The price a guest sees is what they pay.
5.2 We deduct commission at the rate shown in your dashboard, currently 10% of the experience price, and remit the balance to you.
5.3 Payments are made through Stripe. You must complete Stripe's onboarding and keep your details current. We cannot pay you until you do.
5.4 Money is released to you after the experience has taken place, on the schedule shown in your dashboard.
5.5 You are responsible for your own tax, including income tax, corporation tax and VAT. We do not deduct or account for tax on your behalf. Where you are VAT registered, the supply to the guest is yours, not ours.
6.1 You set the cancellation policy shown to guests before they pay.
6.2 If a guest cancels, the refund is calculated under your policy and, where a refund is due, we return it to the guest from the amount we hold or, if already remitted, recover it from you.
6.3 If you cancel a confirmed booking, the guest receives a full refund and we may recover from you any cost we incur, including the payment processing fee. Repeated cancellations may end this agreement.
6.4 You must not ask a guest to pay you outside the platform for anything booked through it.
7.1 Where a guest disputes a payment for your experience and the dispute is upheld, you bear the loss, and we may recover the amount, and any fee charged to us, from money we hold for you or by invoice.
7.2 You will co-operate promptly and provide evidence we reasonably request to defend a dispute.
8.1 You are liable for any loss, injury, damage or claim arising from your experience, your acts or omissions, or your failure to hold a required licence, qualification or insurance.
8.2 You indemnify us against all claims, losses, costs and expenses (including reasonable legal costs) arising from your experience, your breach of this agreement, or your breach of any law.
9.1 Nothing limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
9.2 Subject to 9.1, we are not liable to you for lost profit, lost business, or loss of opportunity, and our total liability to you in any twelve-month period is limited to the commission we retained from you in that period.
9.3 We do not guarantee any level of bookings, visibility or income.
10.1 You keep ownership of the photographs and text you upload, and you grant us a non-exclusive, royalty-free licence to use them to advertise and promote your experiences and the platform.
10.2 You confirm you have the right to use everything you upload, including any photograph containing an identifiable person.
10.3 Each of us is a separate data controller for the personal data we hold. You will handle guest data only to deliver the experience, and in line with data protection law.
11.1 You may stop listing at any time. Bookings already accepted must still be honoured.
11.2 We may suspend or remove your listing, or end this agreement, immediately where you break this agreement, where your insurance or licence lapses, where guests are put at risk, or where we reasonably suspect fraud.
11.3 Money owed to you for experiences already delivered remains payable.
12.1 You are an independent business. Nothing here makes you our employee, worker, partner or joint venturer, except that you appoint us as your agent for the limited purpose in clause 2.2.
12.2 We may change this agreement on reasonable notice. Continuing to list after the change takes effect is acceptance.
12.3 This agreement is governed by the law of Scotland and subject to the jurisdiction of the Scottish courts.
